JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 01-12-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Near about 2000 litres country made liquor was recovered from a pick up van which was being driven by the petitioner at the time of alleged recovery.

Regard being had to the facts and circumstances of the case as well as submissions of the parties, I am not inclined to release the petitioner on bail, at least, at this stage and hence, his prayer for bail in connection with Sangrampur P.S. Case No. 140 of 2015 pending in the court of Chief Judicial Magistrate, Motihari, East Champaran stands rejected.

However, taking note of this fact that petitioner does

No.53997 of 2015 (2) dt.01-12-2015 2/2 not have any criminal antecedent and he appears to be first offender, learned trial court is directed to expedite the trial of the petitioner and try to conclude the same as early as possible, preferably within three months from the date of receipt/production of copy of this order and if the trial of the petitioner is not concluded within the above stated period, the petitioner shall be released on bail by the learned trial court itself fixing the amount of bail bonds on its own level.
