JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 07-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 376 of the Indian Penal Code. The informant has herself admitted in her written report that she was in love with the petitioner since last three to four years and when her marriage was solemnized, petitioner, allegedly, gave threatening and established physical relation with her. The statement of informant was recorded under Section 164 of the Cr.P.C. in which she came before the court with slightly a different story. Moreover, the aforesaid fact goes to show that perhaps informant was a consenting party. The informant appears

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Saran at Chapra in connection with Manjhi P.S. Case No. 246 of 2015.
