The petitioner seeks bail in a case registered for offences punishable under Sections 39(a), 30(a), 38(1), 38(2) and 41(1) of the Bihar Prohibition and Excise Act, 2016. It is contended that, as per allegation, huge quantity of foreign liquor was recovered from different vehicles. It is further contended that ten persons including the petitioner were apprehended from the spot. Petitioner claims that he is in custody since 04.08.2017.

Having regard to the facts and the circumstances of the case, the abovenamed petitioner is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the

Patna High Court Cr.Misc. No.52499 of 2017(2) dt.09-11-2017 2/2 satisfaction of the Second Additional Sessions Judge -cumSpecial Judge, Excise Act, Samastipur in connection with Dalsingsarai P. S. Case No. 239 of 2017.

Further, if the petitioner, after his release in this case, is again found to be involved in similar nature of case then the court concerned would be at liberty to take steps for cancellation of his bail bond.
