2. Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

3. The Petitioner is apprehending his arrest in connection with Majhauliya P.S. Case No. 119 of 2023 registered for the offences punishable under Sections 147, 148, 149, 341, 343, 498A, 504, 307, 506 of the Indian Penal Code and section 3⁄4 of the Dowry Prohibition Act.

4. As per the prosecution case, the petitioner and the

Patna High Court CR. MISC. No.76972 of 2023(2) dt.02-01-2024 2/3 co-accused persons are alleged to have tortured the complainant mentally and physically and tried to set her on fire due to non fulfillment of the demand of 5 katha land and one Tractor as dowry.

5. Learned cousnel for the petitioner has submitted that the petitioners are innocent and have falsely been implicated in this case. The informant and the petitioner both belongs to the same village and the petitioner is ready to keep the informant as wife with full honour and dignity. The petitioner is husband of the complainant and he never demanded any dowry nor tortured her. The petitioner has clean antecedent.

6. Learned A.P.P for the State has opposed the prayer for anticipatory bail of the petitioner

Considering the aforesaid facts and circumstances of the case as well as submission of the parties, let the above named petitioners, in the event of their arrest/ surrender within six weeks from the date of receipt of this order to the court concerned, be released on anticipatory bail on furnishing bail bonds of Rs 10,000/- (twenty thousand) each with two sureties of the like amount each to the satisfaction of the Learned Chief Judicial Magistrate, Bettiah, West Champaran in Majhauliya
