JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 14-12-2015 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks bail in connection with Ekangar Sarai P. S. Case No. 180 of 2006 registered under Sections 341, 324, 307, 379 and 504 read with 34 of the Indian Penal Code and Section 27 of the Arms Act.

It is a case of misuse of privilege of bail. The bail bond of the petitioner was cancelled for want of pairavi vide order dated 03.02.2011. All possible steps taken by the Court below to ensure appearance of the petitioner turned futile and ultimately after declaring him as a permanent absconder, he was apprehended on 3rd September, 2015.

In that view of the matter, I am not inclined to grant bail

Patna High Court Cr.Misc. No.56038 of 2015 (2) dt.14-12-2015 2/2 to the petitioner for the present. Accordingly, the application for bail is rejected.

The Court below is directed to expedite the trial and conclude the same as early as possible, preferably within six months from the date of receipt/production of a copy of this order, failing which the petitioner would be at liberty to renew his prayer for bail before the Court below itself.
