The petitioner is in custody since 08.08.2019 in connection with Jaynagar P.S. Case No. 388 of 2019 for the offence registered under Sections 272 and 273 of the Indian Penal Code and Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the alleged recovery is not from the conscious possession of the petitioner but from the motorcycle, on which, he was traveling. It is further submitted that the petitioner has no criminal antecedent.

Considering the aforesaid facts and circumstances of

Patna High Court CR. MISC. No.61229 of 2019(2) dt.05-11-2019 2/2 the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of IInd Additional Sessions Judge-cum-Special Judge, Excise Act, Madhubani in connection with Jaynagar P.S. Case NO. 388 of 2019.
