JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-10-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Earlier prayer for bail of the petitioner was rejected by this court vide order dated 09-01-2015 passed in Cr. Misc. No. 27098 of 2014, giving liberty to the petitioner to renew her prayer for bail, if, her trial is not concluded within nine months from the date of receipt/production of copy of the aforesaid order dated 1201-2015. The trial court has reported that out of 8 proposed prosecution witnesses, uptill now only three prosecution witnesses could be examined and the process to procure the attendance of remaining prosecution witnesses has already been issued. Patna High Court Cr.Misc. No.16480 of 2016 (3) dt.19-10-2016 2/2 petitioner is languishing in jail custody for near about two years and having more or less similar allegation, one co-accused Md. Kuddus @ Abdul Kuddus has already been granted privilege of bail by a coordinate bench of this court vide order dated 03-052016 passed in Cr. Misc. No. 11800 of 2016. Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Bela P.S. Case No. 21 of 2014 corresponding to Sessions Trial No. 451 of 2014 to the satisfaction of Sri A. K. Dubey, learned Additional Sessions Judge-Ist, Sitamarhi. (Hemant Kumar Srivastava, J) A.K.V./- U T
