JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case initially, registered for the offences punishable under Section 363 of the Indian Penal Code and later on, Section 302 of the Indian Penal Code was also added.
Petitioner is not named in the first information report but he has been made accused in this case on the ground that he left his office along with deceased and subsequently, the dead body of the deceased was found in a ditch. Admittedly, none has seen the actual killing of the deceased and at best, it is a case of last seen. Moreover, the investigation against the petitioner has already been completed and there is nothing on the record to show

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Danapur, Patna in connection with Naubatpur P.S.
