JUSTICE MOHIT KUMAR SHAH ORAL ORDER 25-04-2018 The petitioner by way of the present writ petition has prayed for quashing of Memo No. 1766 dated 04.10.2017 issued by the respondent no. 2 whereby and whereunder the petitioner has been put under suspension and he has been directed to file a show cause.

The learned counsel for the petitioner has produced an order dated 23.10.2017 passed by the Executive Officer, Nagar Parishad, Forbesganj which is taken on record, whereby and whereunder the suspension of the petitioner has been revoked and the petitioner has been pardoned with a warning not to engage in any indiscipline henceforth.

In such view of the matter, the learned counsel for the

Patna High Court CWJC No.15090 of 2017 (2) dt.25-04-2018 2/2 petitioner submits that the authorities be directed to pay the petitioner the arrears of salary for the suspension period. The learned counsel for the respondent nos. 2 and 3 is present.

In view of the aforesaid, the present writ petition is disposed of with a direction to the respondents to pay the admitted arrears of salary for the period the petitioner had remained under suspension. The same be done within a period of four weeks from today.
