JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-09-2019 Petitioner seeks bail in anticipation of his arrest in connection with Hilsa P.S. Case No. 325 of 2019 registered for the offences punishable under Sections 341, 323, 307 and 504/34 of the Indian Penal Code.

Allegation against the accused persons, including the petitioner is that they attacked the informant by means of sharp cutting weapon.

Submission of learned counsel for the petitioner is that FIR itself disclosed that occurrence took place with respect to supply of water and there is case and counter case and no specific allegation has been attributed against him and moreover injuries are simple in nature, which will appear from Annexure2. In view of above facts and circumstances, this application is disposed of with direction to the petitioner to surrender in the court below and on surrender the court below shall release him on provisional bail for a period of one month and in the meantime learned court below will call for the injury report from the PMCH and on perusal of the same the court below shall pass an appropriate order either confirming the bail bonds of the petitioner or directing the petitioner to surrender and pray for regular bail.
