JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 328, 379, 307 of the Indian Penal Code.
Informant along with some others were drugged by some unknown persons on 22.04.2015. The petitioner and some others were arrested after one month of the occurrence and some A.T. VAN tablets and dates were recovered from their possession and on the basis of aforesaid recovery, petitioner and his associate were interrogated and they confessed their guilt and thereafter, they have been remanded in the present case. Moreover, except the
Patna High Court Cr.Misc. No.20543 of 2016 (2) dt.19-05-2016 2/2 aforesaid confessional statement as well as some criminal antecedent, there appears to be nothing against the petitioner, who is languishing in jail custody since 14.03.2016 but till today the police did not take pain to arrange the Test Identification Parade of the petitioner.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Railway Judicial Magistrate, Khagaria in connection with Khagaria Rail P.S. Case No. 14 of 2015.
