The petitioner has renewed his prayer for grant of regular bail in a case registered under section 302, 120B and 34 of the Indian Penal Code and section 27 of the Arms Act. The earlier application for bail of the petitioner was rejected vide order dated 7.3.2022 passed in Cr. Misc. no.46767 of 2021.

As per the prosecution case, the accused persons including the petitioner are said to have come variously armed and as a result of indiscriminate firing resorted to by them, the brother of the informant died.

It is submitted by learned counsel for the petitioner that the earlier prayer for bail of the petitioner was rejected vide

Patna High Court CR. MISC. No. 66515 of 2022(2) dt.30-11-2022 2/2 order dated 7.3.2022 (Annexure-1). A number of co-accused including Saurabh Kumar Singh, Keshav Mishra and others have been enlarged on bail. The petitioner is in custody for more than 1 year 11 months since 11.12.2020 and charge has been framed in the learned trial court against the petitioner. The petitioner undertakes to cooperate in the trial. Heard learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the petitioner having remained in custody for 1 year 11 months, grant of bail to the above mentioned coaccused and charge having been framed in the learned trial court, the petitioner is directed to be enlarged on bail in connection with Sessions Case No. 142 of 2018 (arising out of Bakhri P.S. Case No. 98 of 2017) on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-XI, Begusarai.
