JUSTICE DINESH KUMAR SINGH ORAL ORDER 21-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 302 and 201/34 of the Indian Penal Code.

The informant Shivshankar mahto alleged that four years ago his younger brother Amod Mahto, the deceased was forcefully married with the daughter of Mahindra Mahto. About one week prior to the occurrence Amod Mahto had gone to the house of his in-laws for giving invitation card of the marriage of the daughter of the informant but Amod Mahto did not return. The informant suspected that the petitioner along with others might have killed Amod Mahto.

It is submitted by learned counsel for the petitioner that there is no eye witness of the occurrence. There is no explanation

Patna High Court Cr.Misc. No.26831 of 2015 (2) dt.21-07-2015 2/2 for delayed lodging of the case and the case has been lodged after recovery of the dead body but for one week no intimation was given to the police. Considering the suspicious nature of accusation the in-laws of the victim have been granted anticipatory bail by a co-ordinate bench of this court vide Criminal Miscellaneous No.37656 of 2014.

Considering the same, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Ganga Bridge P.S. Case No.52 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Ashwini/- U T
