Vide order passed on the writ petition, the appellate authority i.e. the Deputy Inspector General of Police, Magadh Range, Gaya was directed to dispose of the appeal. Since it was not disposed of within the time stipulated that this contempt application was filed on 11.04.2018.

On time being granted that a show cause has been filed on behalf of the Deputy Inspector General of Police, Magadh Range, Gaya enclosing an order passed on 11.04.2018, whereby the appeal

Patna High Court MJC No.1176 of 2018 dt.30-08-2018 has been dismissed. A copy of the order bearing Memo No.403 dated 11.04.2018 has been enclosed at Annexure 'O.P-5/E' to the show cause filed on behalf of the Deputy Inspector General of Police, Magadh Range, Gaya and in reference thereto it is submitted by Mr. Saroj Kumar Sharma, learned Assisting Counsel to Additional Advocate General No.3 that though it was passed on the same day, on which the contempt application was filed but due to communication gap it would not be placed earlier. Mr. Niranjan Kumar, learned counsel appearing for the petitioner though endeavours to question the order on merits but for that the forum would be otherwise and not in contempt jurisdiction. The petitioner, if so advised, can question the order of the Deputy Inspector General of Police, Magadh Range, Gaya in an appropriate proceeding by filing appropriate application but for the present, the contempt application is disposed of.
