JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-09-2019 Petitioners seek bail in anticipation of their arrest in connection with Parasbigha P.S. Case No. 61 of 2019 registered for the offences punishable under Sections 341, 323, 379, 307 and 34 of the Indian Penal Code.

So far petitioners are concerned, they are named in the FIR and there is general allegation of assault against them of

Patna High Court CR. MISC. No.59387 of 2019(2) dt.19-09-2019 2/2 assault to son of the informant and there is specific allegation against other accused persons of assault to the informant. Submission of learned counsel for the petitioners is that there is general and omnibus allegation against the petitioners and they have no criminal antecedent. Heard learned APP also.

In view of above facts and circumstances, let petitioners, in the event of arrest or surrender, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Jehanabad, in connection with Parasbigha P.S. Case No. 61 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioners shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
