This is an application for bail in connection with Khagaria (Gangour) P.S.Case No. 398 of 2017 registered for the offences punishable under Sections 25(1-B)(a), 26, 35 of the Arms Act, 3/4 of Explosive Substance Act and 16, 17, 18, 20, 22 and 23 of U.A.P. Act.
Petitioner is named in the FIR and it is alleged that some receipts were recovered from his possession and allegation is of collecting levy from local people.
Submission of learned counsel for the petitioner is that except seizure there is nothing against the petitioner and he is in custody for five months. Further submission is that though he is accused in two other cases but he is on bail in those cases. Heard learned APP also.
Patna High Court Cr.Misc. No.52780 of 2017 (2) dt.21-11-2017 2/2 Having heard both sides and considering the facts and circumstances of the case, let petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Khagaria, in connection with Khagaria (Gangour) P.S.Case No. 398 of 2017, G.R. No. 1654 of 2017, subject to the following conditions :- (1) One of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned, (2) Petitioner will mark his attendance in local police station in first week of every month at least for a period of one year, so that police may watch his conduct during the said period, failing which his bail bond shall be cancelled.
Let this order be communicated to the Superintendent of Police, Khagaria for its compliance.
