JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-09-2019 This is an application for grant of anticipatory bail in connection with Laukahi P. S. Case No. 185 of 2018, disclosing offences under Sections 272 and 273 of IPC and Section 30(a) of the Bihar Prohibition and Excise Act, 2016. Allegation against the petitioner is of recovery of 39 liters of liquor from the Gumti of the petitioner. Submission of the learned counsel for the petitioner is that the petitioner has been falsely implicated in this case, due to enmity. He has no criminal antecedent. Further submission is that Gumti is not of the petitioner.

Heard learned A.P.P. also.

Having heard both sides, in view of the allegation and the quantity of the liquor recovered, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below

Patna High Court CR. MISC. No.59687 of 2019(2) dt.23-09-2019 2/2 and make prayer for regular bail, the same shall be considered by the learned court below on its own merit, without being prejudiced by order of this Court.
