1. Heard the parties.

2. The petitioner apprehends his arrest in connection with Katihar Town (Sahayak) P.S. Case No. 431 of 2023 dated 11.06.2023 registered under Sections 341, 448, 323, 307, 354 (B) / 34 of the I.P.C.

3. As per the prosecution case the petitioner along with his wife assaulted the informant's daughter by means of iron rod due to which she sustained injury. They tore her clothes also.

4. Learned counsel for the petitioner submits that both the parties are next door neighbours. The petitioner has been implicated in this case due to petty dispute between them. The allegation against the petitioner is general and omnibus in nature. The injuries caused to the informant's daughter are

5. Learned counsel for the informant opposed the prayer for anticipatory bail and submits that the informant's daughter has sustained injuries on her head and the petitioner along with his wife are specifically named in the F.I.R.

6. Learned counsel for the State submits that it is true that injuries caused to the informant's daughter are simple in nature.

7. Regard being had to the submission made by the parties, taking into consideration the fact that both the parties are next door neighbours and injuries caused to the informant's daughter are simple in nature, accordingly, provisional bail granted by this Court vide order dated 09.11.2023 is hereby confirmed. The bail bond furnished by the petitioner at the time of provisional bail shall be treated to be the bail bond in the present scenario.

8. The application stands disposed of.
