Mr. Arvind Kumar, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SHAILENDRA SINGH ORAL ORDER 28-02-2023 Let the defects, if any, pointed out by the office be removed within three weeks from the date of this order, failing which the matter be listed again under the appropriate heading for necessary action.

Heard learned counsel for the petitioner and the learned APP for the State.

Petitioner seeks regular bail in connection with Alamnagar P.S. Case No. 145 of 2022 registered for the offences punishable under Sections 420, 467, 468, 471 and 120(B) of the Indian Penal Code.

As per the prosecution, the informant alleged that this petitioner was appointed as 'Panchayat Shiksha Mitra' in 2005, on enquiry his 12th marksheet was found to be forged.

Patna High Court CR. MISC. No.68716 of 2022(2) dt.28-02-2023 2/2 The main submissions advanced by learned counsel for the petitioner are that the petitioner has fair and clean antecedent and he has been languishing in jail since 17.06.2022 and he did his service on the post of 'Panchayat Shikshak' for seventeen years before retiring from the service and he was selected on that post after due verification of all his educational documents in question.

Learned APP for the State has opposed the bail prayer. Considering the aforesaid facts and mainly custody period of the petitioner and also the fact that the investigation has been completed and prosecution's case is mainly based on documentary evidence, in my view, it is a fit case for bail to the petitioner. Accordingly, let the petitioner named above be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of concerned Court in connection with Alamnagar P.S. Case No. 145 of 2022.

Petitioner shall cooperate in the trial and shall remain present physically on each and every date whenever his physical presence is required by the Trial Court.
