====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 16-12-2022 Heard learned counsel for the petitioners and learned A.P.P. for the State.

Petitioners apprehend their arrest in a case registered for the offences punishable under Section 272, 273, 34 of the Indian Penal Code and 30(a) Bihar Prohibition and Excise Act. As per prosecution case, 15 litres of country made liquor has been recovered from the house of co-accused Md. Gulab. Learned counsel for the petitioners submits that the petitioners have falsely been implicated in this case. No incriminating material has been recovered from the conscious possession of the petitioners. Name of the petitioners transpired during the course of investigation. Petitioners have got no criminal antecedent.

No.65941 of 2022(2) dt.16-12-2022 2/2 Considering the aforesaid facts and circumstances, let the above named petitioners in the event of their arrest/surrender before the Court below within a period of thirty days from the date of receipt/production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional Sessions Judge cum Special Judge Excise Act, Madhubani, in connection with Rajnagar P.S. Case No. 211 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
