The petitioner seeks bail in Mufassil P.S. Case No. 360 of 2017 registered under Sections 341, 354, 447, 504 and 506/34 of the Indian Penal Code.
Petitioner is said to have made an abortive bid to disrobe the informant in order to outrage her modesty entering into her hut and subsequently extended threatening of dire consequence in case of filing case against him. It is submitted by learned counsel for the petitioner that no such occurrence as alleged ever took place. The petitioner happens to be gotiya of the informant and has been falsely
Patna High Court Cr.Misc. No.54082 of 2017 (2) dt.14-11-2017 2/2 implicated in the case due to petty dispute. The petitioner has been languishing in custody since 29.08.2017. The occurrence is said to be of 21.07.2017, but F.I.R. has been lodged on 14.08.2017 after an inordinate and abnormal delay of 24 days without assigning any plausible reason for the said delay which creates serious doubt about the prosecution case.
Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai in connection with Mufassil P.S. Case No. (Prakash Chandra Jaiswal, J) Mishra/- U T
