Perused the impugned order dated 02.09.2016 passed by learned Civil Judge (Junior Division)-II, Munger in Eviction Suit No.04 of 2014-CIS (Eviction 16 of 2016) whereby the petitioner's defence has been struck off for non-compliance of order dated 23.06.2016 passed under Section 15 of the B.B.C. Act. Perused the order dated 23.06.2016 and the impugned order dated 02.09.2016.
The learned counsel for the petitioner admitted the fact that he has not fully complied the order under Section 15 of the B.B.C. Act passed by the court below. Therefore, order dated 02.09.2016 is consequential order.
In such view of the matter, I find no reason to interfere
Patna High Court C.Misc. No.273 of 2017 (2) dt.16-02-2017 with the impugned order in exercise of supervisory jurisdiction. Accordingly, this civil miscellaneous application is dismissed. (Mungeshwar Sahoo, J) Harish/- U
