This is an application for regular bail on behalf of the petitioner for the offences alleged under Sections 399, 402, 411, 412, 414 and 420/34 of the Indian Penal Code, Sections 25(1-b)a/26/35 of the Arms Act and Sections 20(B)(11)/B25/29 of the NDPS Act, registered in connection with Patepur P.S.Case No. 169 of 2020Lauriya P.S.Case No. 235 of 2020. The police got an information that some criminals had assembled in a garden to commit serious offence. The police party reached that place and on seeing the police the accused persons started fleeing away. The arrested accused persons apprised the names of other miscreants, who became successful

Patna High Court CR. MISC. No.1708 of 2023(2) dt.01-05-2023 2/3 in fleeing away and the petitioner was one of them. The learned counsel for the petitioner has submitted that the petitioner was not arrested on the spot. Nothing was recovered from his possession and he is in custody since 24.06.2022. In three cases mentioned in paragraph no.3, he has been acquitted, whereas in other two cases he is on bail. He has submitted further that co-accused Md. Yasin @ Chotu, who was arrested at the spot, has been granted bail by a coordinate Bench of this Court in Cr.Misc.No.61614 of 2022 and the case of the petitioner is on better footing.

Considering the above facts and circumstances, let the petitioner, above-named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Vaishali at Hajipur in connection with Patepur P.S.Case No. 169 of 2020, subject to the following conditions:-

1. The petitioner shall cooperate in the disposal of trial and make available available as and when required by the court.

2. If the petitioner is found involved in future in the similar type of offence, the prosecution will have liberty to file an application
