JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-12-2015 The present application has been filed for modification of the order dated 13.08.2015 passed in Criminal Miscellaneous No.32811/2015 to the extent that in the seventh paragraph, of the order inadvertently, "learned District and Sessions Judge, Buxar" has been recorded in stead of "learned Chief Judicial Magistrate, Buxar, ". The said mistake perpetuated in the order since it was wrongly mentioned in the main petition. Hence, learned counsel for the petitioner is permitted to make necessary correction in the main petition. In view of the aforesaid, in the seventh paragraph of the order dated 13.08.2015 be read as "learned Chief Judicial Magistrate, Buxar" in stead of "learned District and Sessions Judge, Buxar".

Let the date of surrender be extended by two weeks calculated from the date of receipt or production of the order in

Patna High Court Cr.Misc. No.47167 of 2015 (2) dt.09-12-2015 2/2 connection with Itarhi P.S. Case No.120 of 2013, pending before the learned CJM, Buxar.

The order dated 13.08.2015 passed in Criminal Miscellaneous No.32811/15 stands modified to the extent as indicated above.
