2. Shyam Sundar Dahlan S/o. late Chandi Dahlan, R/o. Mohalla- Dahlan Chock, Ward No.20, Police Station- Sadar (Saharsa), District- Saharsa .... .... Opposite Party/s ====================================================== Appearance :

For the Petitioner/s : Mr. Shekhar Kumar Singh, Advocate For the Opposite Party/s : Mr.

====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 11-04-2018 Opposite Party No.2 was granted bail in connection with Saharsa (Mahila) P.S. Case No.5 of 2017 by the learned Court-below on 02.03.2017 considering the fact that the offences alleged were apparently bailable. Thereafter, the petitioner, who is informant of that case, filed a petition for cancellation of bail on the ground that though the anticipatory bail application of Opposite Party No.2 was pending before the learned Sessions Judge, this fact was suppressed on the date of surrender. Further on the ground that non-bailable offences under Sections 384/354/354B were there after supervision note of the Supervising Authority.

It appears that the prayer for cancellation was considered and refused on 02.05.2017 by the learned Court-below.

Patna High Court Cr.Misc. No.58662 of 2017 (5) dt.11-04-2018 P2/ The same is challenged in this application. Learned counsel for the petitioner further submits that Opposite Party No.2 has criminal antecedent.

After hearing the parties, I do not find any merit in this application. Hence, it stands dismissed.
