The petitioner by invoking the extraordinary writ jurisdiction of this Court under Article 226 of the Constitution, seeks a direction upon the respondents concerned to transfer the demand in the name of the petitioner and others as the said demand is still running in the name of forefather of the petitioner and others and further to issue rent receipt in their favour.

3. Learned counsel for the petitioner contended that for redressal of the grievance as raised before this Court, the petitioner has filed appropriate application before the Circle

Patna High Court CWJC No.14600 of 2024(2) dt.24-09-2024 2/2 Officer, Rafiganj, Aurangabad, but till date the same has not been considered and brought to its logical conclusion.

4. Learned counsel for the State contended that the application has not been filed in accordance with the practice prevalent in the Circle Office.

5. Considering the submissions advanced on behalf of the parties and taking note of the grievance, this Court deems it fit and proper to dispose off the writ petition with a direction to the petitioner to file an appropriate application before respondent no.4, the Circle Officer, Dhanawa, Aurangabad, for redressal of his grievance as prayed before this Court.

6. Suffice it to say that, if an appropriate application is filed before respondent no.4, preferably within a period of four weeks from today, the concerned respondent shall take up the application and dispose of the same in accordance with law under the statutory provisions of the Bihar Land Mutation Act, 2011, preferably within a period of four months thereafter.

7. The writ petition stands disposed of with the aforesaid direction.
