JUSTICE DINESH KUMAR SINGH ORAL ORDER 03-02-2016 The present application has been filed for modification of the order dated 03.09.2015 passed in Cr. Misc. No. 41831 of 2015 in a case registered for the offences punishable under Sections 323, 379, 498A/34, 504 of the Indian Penal Code.

The petitioner being mother of the husband of the informant was granted anticipatory bail vide order dated 03.09.2015 passed in Cr. Misc. No. 41831 of 2015 on submission of the learned counsel for the petitioner that petitioner being mother of the husband of the informant is ready to keep the informant with dignity and honour. Now, it is submitted by learned counsel for the petitioner that the said statement in para 7 of the petition was wrongly made which reads as follows:- "That the petitioner is still ready

No.2233 of 2016 (2) dt.03-02-2016 2/2 to keep the complainant with full dignity and honour" In view of this Court, the consideration for grant of bail to the petitioner was the above submission made in para 7 of the petition. Hence, this Court is not inclined to modify the order dated 03.09.2015 passed in Cr. Misc. No. 41831 of 2015.

Accordingly the modification application stands dismissed in connection with Jamui Mahila P.S. Case No. 34 of 2013.
