The grievance of the petitioner in the present writ application non payment of salary for the period he has discharged the duty. The issue of payment of salary requires enquiries as to the facts, whether the petitioner has worked during the period in question and whether the appointment of the petitioner is legal and valid. In view of the above, the writ petition is disposed of with a direction to the respondents to take final decision on the
Patna High Court CWJC No.6847 of 2016 dt.26-03-2018 2/2 petition for payment of arrears and current salary within a maximum period of 60 days from the date of receipt/production of a copy of this order after verification of the record as to the validity of appointment of petitioner and also on the point whether the petitioner has actually worked or not. In case, petitioner's claim is found not justified, speaking order may be passed for rejecting the claim of the petitioner for payment of salary.
