1. The present writ petition has been filed seeking the following relief(s):- "1. That this is an application for issuance of a writ of Mandamus directing the respondent authorities to get the house of the petitioner constructed at the cost of the Govt. On Khata No. 347, Plot No. 1798, Thana No. 398, Area 1.1/2 decimal (32 Feet x 13 feet) at village Pahari, P.O.- Bothani, P.s. Karagahar, District - Rohtas

Patna High Court CWJC No.15947 of 2023(2) dt.13-08-2024 2/2 interalia the following:- i. Respondent authorities be directed to take steps for demolition of the houses and shops of the private Respondents in the light of Letter No.246 dated 05.04.2022 issued by the Learned DCLR, Sasaram.

ii. The alternative prayer is that respondent authorities be directed to construct the house of the petitioner at the cost of the Govt. or they be directed to pay compensation of Rs. Fifty Lacs to the petitioner because of the discriminatory and cruel action taken by the Circle Officer, Kargahar, Rohtas."

Though, it is admitted by the learned counsel for the petitioner that the petitioner is not in possession of any documents to show his right, title and interest over the land/shop in question, however, he submits that similarly situated 31 other shopkeepers are also encroachers but they are not being removed, hence he be granted liberty to approach the District Magistrate, Rohtas for needful. Liberty so sought is granted.

3. The writ petition stands disposed off.
