The petitioner seeks bail in connection with Pasraha P.S. Case No. 44/2017, registered for the offences punishable under Sections 489(b), 489(c) and 420 of the Indian Penal Code. Twenty eight fake currency notes of 100 denominations are said to have been recovered from the possession of the accused Arbind Kumar and on the basis of his confessional statement, petitioner was apprehended and a currency note of 50 denomination is said to have been recovered from his possession which also appears to be fake.
It is submitted by the learned counsel for the petitioner that the currency note recovered from the possession of the petitioner is genuine one and not fake. There is no scientific report
Patna High Court Cr.Misc. No.53895 of 2017 (2) dt.09-11-2017 2/2 regarding the fakeness of the aforesaid currency notes. There is nothing in the case diary indicating the complicity of the petitioner. Petitioner is languishing in custody since 08.04.2017. Considering the facts and circumstances of the case, the petitioner above named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate II, Khagaria in connection with Pasraha P.S. Case No. 44/2017.
