JUSTICE SHAILENDRA SINGH ORAL ORDER 13-10-2025 The instant writ petition has been filed by the petitioner under Article 226 of the Constitution of India seeking the following reliefs:- a) To issue a writ in the nature of mandamus directing the concerned respondent to furnish the relevant information as to how the respondent no.3 through their arbitrary actions acquired the land measuring approximately 2667.09 Square feet situated at Mauza Jaganpura, Khata Np. 13, Plot no. 1223 under revenue thana Phulwari Sharif;

b) To issue a writ in the nature of mandamus directing the concerned respondents to pay the compensation amount alongwith statutory interest from the date of acquisition till

c) Any further or other relief which this Hon'ble Court may deem fit and proper in the facts and circumstances of the case.

2. Heard Mr. Kumar Gaurav, learned counsel for the petitioner, Mr. Prasoon Sinha, learned senior counsel for the Patna Municipal Corporation and Mr. Jitendra Kumar Roy, learned SC-13 for the State-respondents.

3. The main grievance of the petitioner is that his land measuring approximately 2667.09 square feet situated at Mauza Jaganpur, Khata No. 13, plot no. 1223 under revenue thana- Phulwari Sharif has been used by the Patna Municipal Corporation for widening of the existing road before the year 2018. Admittedly, the petitioner has come before this court several years after the widening of the road but as per petitioner's counsel the petitioner had no information about the widening of the road over his land before the year 2018 as he had shifted to Ranchi and when he visited his land in the year 2018 he got the information regarding widening of the road over his land and thereafter from the year 2018 to May, 2025 he is running from pillar to post for getting information with regard to the widening of the road over his land and also filed an application under Right To Information Act. The petitioner has

Patna High Court CWJC No.15457 of 2025(2) dt.13-10-2025 3/3 also filed a representation dated 30.05.2025 (Annexure- P/4) before the Chief Executive Officer, Patna Municipal Corporation, respondent no.4 to redress his grievance which is still pending.

4. As the petitioner's representation dated 30.05.2025 is still pending, so, at this stage it will not be proper to invoke the writ jurisdiction of this court to redress the petitioner's grievance.

5. Accordingly, this writ petition stands disposed of with a direction to the respondent no.4 before whom the petitioner's representation dated 30.05.2025 is pending to dispose of the same at the earliest, preferably, in the next four months from the date of receipt/ production of a copy of this order, as per the provisions of law and according to merit.
