2. The petitioner apprehends arrest in connection with Tekari P.S. Case No. 151 of 2025 dated 27.03.2025, registered for the offence punishable under Sections 137, 96 and 303(2) of the Bharatiya Nyaya Sanhita, 2023.

3. The prosecution case, in short, is that on the date of occurrence at about 12.00 P.M. the minor daughter of the informant aged about 16 years went to market for purchasing medicine but she did not return home till evening. During course of search, he got information that her daughter was kidnapped by the petitioner by seducing her. When the informant tried to connect the petitioner, he found his mobile

Patna High Court CR. MISC. No.63107 of 2025(2) dt.10-09-2025 2/3 switched off. The daughter of the informant is also alleged to have taken cash of Rs. 10,000/- and jewellery worth Rs. 1,00,000/- with herself.

4. Learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in this case. It is submitted that there was love affairs between the petitioner and the victim. The victim herself eloped with the petitioner out of her sweet will and performed marriage in a temple on 08.06.2025. The statement of the victim has been recorded under Section 183 B.N.S.S., 2023 in which the victim has not alleged anything against him. Both the petitioner and the victim has sworn affidavit regarding their marriage which is annexed as Annexure-2. It is submitted that the daughter of the informant is residing with the petitioner. It is further submitted that the allegation against the petitioner is false and fabricated. It is submitted that the daughter of the informant is aged about 18 years. Lastly, it has been submitted that the petitioner has no criminal antecedent.

5. Learned A.P.P. has opposed the prayer for bail of the petitioner.

6. Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, in

Case No. 151 of 2025, he shall be released on anticipatory bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-VI, Gaya, subject to condition as laid down under Section 482(2) of B.N.S.S. as also subject to the condition that wife, namely, Mona Kumari should be one of the bailors of the petitioner.
