1. Heard learned counsel for the parties.

2. The petitioner in this application prays for grant of anticipatory bail apprehending his arrest in connection with Alamganj P.S. Case no.224 of 2025 registered for the offence punishable under sections 196, 299, 353, 292, 293 and 223 of the of the Bharatiya Nyaya Sanhita, 2023 and section 9 of the Bihar Control of the use and Play of Loud Speakers Act, 1955.

3. As per the prosecution case the informant states that in the procession (Sobha Yatra) taken out on the occasion of Mahashivratri some persons were hurling objectionable statement resulting in communal tension.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case. He was a licence holder for the procession and the allegations levelled in

Patna High Court CR. MISC. No.64169 of 2025(2) dt.17-09-2025 2/2 the FIR are categorically denied. The petitioner has no criminal antecedent and undertakes to cooperate in the investigation/trial.

5. The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the allegations against the petitioner in the F.I.R. together with the petitioner not having any criminal antecedent, in the facts of the case it is directed that the petitioner above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks, be released on anticipatory bail in connection with Alamganj P.S. Case no.224 of 2025 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-VI, Patna City, Patna.
