Petitioner, who is in custody, seeks bail in a case registered for the offences punishable under Sections 302, 201 of the Indian Penal Code.
Informant has alleged in his written complaint that his son Manoj Ram with his wife Rita Devi and his brother-in-law (petitioner) with Rita Devi resided in the house and petitioner developed illicit relation with Rita Devi for which his son Arun Ram protested. On 13.01.2019 at about 11:30 A.M. both went for fishing but thereafter his son did not return. It is alleged that on 15.01.2019 the dead body of his son wrapped in a bed-sheet was found near the fishing pond, he suspected that petitioner has

It has been submitted on behalf of the petitioner that he is innocent and has committed no offence. He has been falsely implicated in this case on the basis of suspicion and except suspicion there is no any other incriminating material found against him. There is no eye-witness of occurrence. He has no criminal antecedent and is in custody since 18.06.2019. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 20,000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea, in connection with K. Nagar P.S. Case No. 24 of 2019, subject to conditions:
(1) Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned.
(2) Petitioner shall co-operate in the trial and shall be represented on each and every date fixed by the court.
(3) If the petitioner tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner.
