2. The petitioner apprehends his arrest in connection with Mahua P.S. Case No. 575 of 2023 registered under Sections 363, 366 and 34 of the Indian Penal Code. 3 . As per F.I.R., on the alleged date and time of occurrence , all the accused persons including this petitioner kidnapped the minor daughter of the informant for unlawful purpose .
4. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case merely because he happens to brother of co-accused Raja Kumar. Further submission is that co-accused Raja Kumar and the daughter of informant were
Patna High Court CR. MISC. No.68482 of 2024(2) dt.27-09-2024 2/3 having love affair due to which she left her house with her own will. When informant came to know about this fact, he realized his mistake and gave a petition dated 16.10.2023 before the concerned Court stating therein that due to mistake, this petitioner has been implicated in the present case, the copy of said petition is annexed as Annexure-2 to the bail petition . Similarly situated co-accused persons have already granted bail by this Court vide order dated 15.05.2024 in Cr. Misc. No. 20488 of 2024 . Petitioner claims clean antecedent. 5 . Learned counsel for the informant does not dispute the above submission .
6. Having considered the fact that similarly situated co-accused person with similar allegation has already been granted bail by this Hon'ble Court, clean antecedent of petitioner and other circumstances of the case , let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below within a period of six weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate-I Class Vaishali at Hajipur in connection with Mahua P.S. Case No. 575 of 2023, subject to the conditions as laid down under Section 438(2) of
