JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-09-2019 Petitioners seek bail in anticipation of their arrest in connection with Imamganj P.S. Case No. 06 of 2019 registered for the offence punishable under Section 30(a) of Bihar Prohibition and Excise Act, pending in the court of Special Judge, Excise, Gaya.

As per FIR there is allegation of recovery of huge quantity of liquor and articles for manufacturing liquor and villagers have named these petitioners and other accused persons that they were running the liquor vatti. Submission of learned counsel for the petitioners is that no name of villager has been mentioned and nothing has

Heard learned APP, who has opposed the prayer for anticipatory bail of the petitioners.

In view of above facts and circumstances, this application is disposed of with direction to the petitioners to surrender in the court below within a period of two weeks from the receipt of this order and pray for regular bail and learned court below shall verify the submission of the petitioners that no name of villager, who has disclosed the names of the petitioners, has been mentioned in the FIR and consider other aspects of the matter, including the materials available on the record and try to dispose of the bail application of the petitioners on the same day.
