Petitioner apprehends arrest in a case registered for the offences punishable under Sections 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018. As per prosecution case, 539.640 litres foreign liquor has been recovered from bush. Name of the petitioner has been disclosed by one co-accused Kali Charan.

Learned Counsel for the petitioner submits that the petitioner has falsely been implicated in this case. No incriminating material has been recovered from the conscious possession of the petitioner and he is in way connected with the aforesaid recovery. Petitioner has got clean antecedent. Considering the aforesaid facts and circumstances, let

No.65431 of 2022(2) dt.16-12-2022 2/2 the above named petitioner in the event of his arrest/surrender before the court below within a period of thirty days from the date of receipt/production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of 2nd Additional District and Sessions Judge-cum-Exclusive Special Excise Court-I, Siwan in Pachrukhi (Sarai) P. S. Case No. 107 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
