The petitioners are in custody in a case registered under Sections 363, 366A, 372 and 120B of the Indian Penal Code.

The prosecution case, in brief, is that on 2.3.2015, the daughter of the informant, namely, Shivani Kumar, who was the examinee of Inter (Science), had gone to Marwari School, Darbhanga with Reena Devi, the wife of the informant. It is stated that at 9.45 P.M., his daughter take her seat in that school in Room No.14 and the named accused Md. Ajim Alam of Village Baheri, Muslim Tola was also sit in the same room. It is alleged that at the end of 1st sitting examination at 1.00 P.M. the informant went to search his daughter in Room No.14, but his

Patna High Court Cr.Misc. No.21288 of 2015 (2) dt.13-07-2015 2/2 daughter and Md. Ajim Alam were found absent. It is alleged that accused enticed away his daughter for the purpose of marriage.

On behalf of the petitioners, it has been submitted that the petitioners are in custody since 18.3.2015 and the charge sheet has been submitted in the case. Further, it is submitted that the main allegation is against Md. Ajim Alam. As far as the petitioners are concerned, they are maternal uncle of Md. Ajim Alam.

On behalf of the State and the informant, it has been submitted that the petitioners have been named in the statement under Section 164 Cr.P.C. made by the victim. Considering the aforesaid facts and circumstances, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Darbhanga, in connection with Darbhanga Town P.S. Case No.39 of 2015.
