JUSTICE DINESH KUMAR SINGH ORAL ORDER 22-05-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 302, 504 and 120B/34 of the Indian Penal Code.

It is alleged that the petitioners loaded the pistol and gave it to co-accused Upendra Singh who shot fire on the younger brother of the informant namely Saurav Kumar who died after receiving gunshot injury.

It is submitted by learned counsel for the petitioners that the accusation of firing is not alleged against the petitioners and in the background of land dispute, the accusation has been levelled. A statement has been made in para 3 of the petition that the petitioners have no criminal antecedent.

Considering the aforesaid facts, let the above named

Patna High Court Cr.Misc. No.22250 of 2015 (2) dt.22-05-2015 2/2 petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Khagaria in connection with Alauli P.S. Case No. 267 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
