JUSTICE SUDHIR SINGH ORAL ORDER 01-10-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 295, 397, 120(B) of the Indian Penal Code and 3 / 4 of Explosive Substance Act.

It is alleged by the informant that on 24.06.2014 at about 12.00 P.M. this petitioner along with other co-accused persons entered in the house of the informant and committed dacoity in the house of the informant. They brutally assaulted the informant and his family members and on the point of revolver looted house hold articles. It is further alleged that the occurrence has taken place at the instance of this petitioner and his other wife, namely, Nidhi Jha and he brother.

On behalf of the petitioner, it has been submitted

Patna High Court Cr.Misc. No.27069 of 2015 (4) dt.01-10-2015 2/3 that the petitioner has been falsely implicated in the present case The petitioner is none else but the son-in-law of the informant. Due to family dispute, he has been falsely implicated in the present case with the allegation that at his instance the alleged occurrence is said to have taken place by 25-30 unknown persons. It is also submitted that there are several litigations between the informant and the petitioner and some of the criminal cases have been quashed by this Hon'ble High Court, which is evident from Annexure 3 series.

On behalf of the State, it has been submitted that the petitioner is named in the FIR.

Considering the aforesaid facts, let the above named petitioner, in the event of his arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Jhanjharpur in connection with Madhepur P.S.Case No. 87 of 2014 (G.R.No. 979 of 2014), subject to the conditions as laid down u/s 438(2) Cr.P.C.
