The petitioner seeks bail in Kudhani (Turki O.P.) P.S. Case No. 147 of 2017 registered under Sections 341, 323, 352, 452, 307, 504 and 506 of the Indian Penal Code. The petitioner is said to have resorted firing upon the informant by pistol, but it missed the fire.
It is submitted by learned counsel for the petitioner that no such occurrence as alleged ever took place. As a matter of fact, petitioner has been falsely implicated in the case by the informant in order to grab his property regarding which father of the informant has lost a case in the court of DCLR, West,
Patna High Court Cr.Misc. No.54023 of 2017 (2) dt.13-11-2017 2/2 Muzaffarpur. Regarding recovery of the alleged fire arm from the possession of the petitioner, he has been enlarged on bail by this court. The informant has not sustained any injury. He has been languishing in custody since 16.04.2017.
Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, West, Muzaffarpur in connection with Kudhani (Turki O.P.)
