JUSTICE SUDHIR SINGH ORAL ORDER 28-09-2016 Heard learned counsel for the petitioners and the State. The petitioners seek bail in a case instituted under Sections 302/34 of the Indian Penal Code.

Allegation against petitioners is that they assaulted brother-in-law of the informant with lathi, danda, iron rod etc. due to land dispute. As a result of which brother-in-law of the informant died in course of treatment.

It has been submitted on behalf of the petitioners that they are in custody since 7.3.2016. Chargesheet has been submitted against petitioners. They have got no criminal antecedent. No allegation of tampering of witnesses is alleged against petitioners. General and omnibus allegation has been made. No specific allegation has been made against petitioners. It is further submitted that petitioners may be released after completion of nine months in custody, i.e., from 7.3.2016. On behalf of the State, it is submitted that petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioners be released on bail after completion of

No.34147 of 2016 (3) dt.28-09-2016 2/2 nine months in custody, i.e., from 7.3.2016 on furnishing bail bond of Rs. 10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of learned SubDivisional Judicial Magistrate, West, Muzaffarpur, in connection with Kanti P.S. Case no. 105 of 2016.
