JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 16-12-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual court proceedings. The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 30(A)/ 41 of the Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner submits that petitioner is innocent, not named in the FIR and has been falsely implicated in this case. He submits that there is no recovery from the conscious possession of the petitioner rather 20 liters of country made liquor and utensils used for manufacturing of the liquor is said to have recovered from the spot. He submits that the petitioner managed to flee away from the spot. He further submits that the local Chaukidar has disclosed the name of the petitioner. He further submits that petitioner has no

Considering the facts and circumstance of the case as well as the fact that petitioner is a member of syndicate who are involved in manufacturing of illicit liquor, I am not inclined to enlarge the him on bail. Accordingly, his prayer for anticipatory bail is rejected in connection with Nardiganj P.S. Case No. 242 of 2021.
