The sole petitioner , who is in custody in Ballia P.S. Case No. 303 of 2015 registered for the offence under section 363, 366A/ 34 of the Indian Penal Code , has prayed for grant of bail. It was submitted by learned counsel for the petitioner that petitioner has falsely been implicated, however after going through the F.I.R. as well as the statement of the victim girl recorded under section 164 of the Cr.P.C. the Court is of the opinion that in such case there is no question for grant of bail. Patna High Court Cr.Misc. No.34761 of 2016 (2) dt.22-08-2016 2/2 who was aged about twelve years has categorically stated about how she was kidnapped by the petitioner, who was a teacher and continuously raped.
The petition stands dismissed.
