The petitioners seek bail in Bithan P.S. Case No. 145 of 2017 registered under Section 273 of the Indian Penal Code and Sections 30(a) and 30(c) of the Bihar Prohibition and Excise Act, 2016.
Three liters of foreign liquor and some cash are said to have been recovered from the possession of the petitioners. It is submitted by learned counsel for the petitioners that the money recovered from the possession of the petitioners has been earned by them by working as labourer in Punjab and no incriminating article has been recovered from their conscious physical possession. The petitioners have been languishing in
Patna High Court Cr.Misc. No.54092 of 2017 (2) dt.14-11-2017 2/2 custody since 24.08.2017.
Considering the facts aforesaid, the above named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II, Samastipur in connection with Bithan P.S. Case No. 145 of 2017.
