The petitioner seeks bail in a case under Section 302 and other sections of the Indian Penal Code.

The informant, wife of the deceased, alleged that her husband had gone to grazing cattle. She alleged that Uddin Mian twisted the neck of her husband and the petitioner also pressed the neck of her husband.

It is submitted that no injury was found on the neck. The informant is not an eye witness of the occurrence and on same and similar allegation Uddin Mian, who is alleged to have twisted the neck of the deceased, has already been enlarged on bail vide order passed in Cr. Misc. No. 7127 of 2015 and the case of petitioner stands on the same footing.

Considering the facts aforesaid and the nature of

No.40127 of 2015 (2) dt.01-09-2015 2/2 allegation made against the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Lalan Kumar, learned Judicial Magistrate, 1st class, Jamui in Chakai P.S.
