JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-09-2019 This application, for grant of anticipatory bail, arises out of Mahila (Bhabhua) P.S. Case No. 04/18, disclosing offences under Sections 498(A), 379/34 of the Indian Penal Code and Section 3 /4 of the Dowry Prohibition Act. As per F.I.R. allegation of demand of dowry and a golden chain by the petitioner, who is husband of the informant and for that he subjected the informant to torture and cruelty. It appears that the matter was almost compromised before the court below and both the parties were directed to live with each other but later on petitioner did not appear and due to that the same could not be implemented.
Submission of learned counsel for the petitioner is
Patna High Court CR. MISC. No.60222 of 2019(2) dt.24-09-2019 2/2 that he is still ready to keep the informant - wife with full honour and dignity and as he was living in Punjab, he could not appear..
Heard learned A.P.P. also.
Having heard both sides, considering the facts and circumstances though, I am not inclined to grant the privilege of anticipatory bail to the petitioner. However, petitioner is at liberty to approach the informant and persuade her to come along with him and appear before the court below while praying for grant of regular bail and if any such application for grant of regular bail is filed, the same shall be disposed of by the learned court below on the basis of above facts.
