Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 324, 504, 448, 379, 307/34 of the Indian Penal Code. It is alleged that the accused persons assaulted the informant, causing injury with knife on the abdomen of the informant and snatched Rs. 40,000/- and ornaments of his wife.

It is submitted by the learned counsel for the petitioner that petitioner is the own brother of the informant and in the background of land dispute accusation has been levelled. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent. Moreover, the injury report suggests no injury with knife.

Patna High Court Cr.Misc. No.38746 of 2015 (2) dt.29-09-2015 The aforesaid facts constitute ground for consideration of prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Barahara (Krishnagarh) P.S. Case No. 174 of 2010, pending in the court of learned Chief Judicial Magistrate, Bhojpur, Ara. With this observation this application is disposed of.
