====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 26-09-2019 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner is in custody in connection with Durgawati P.S. Case No. 201 of 2019 for the offences under Sections 414, 120(B) of Indian Penal Code and 30(a) of Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. In the instant case total 172.080 ltrs of illicit liquor was seized. The petitioner is in custody since 22.07.2019.

Considering the fact that the petitioner has no criminal antecedent, the Court is inclined to grant bail to the petitioner subject to cash deposit of Rs. 50,000/- (Fifty thousand) in the Court below and on deposit of the same, the Court below shall

No.59770 of 2019(2) dt.26-09-2019 2/2 release the petitioner, above named, on bail on furnishing bail bonds of Rs. 25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge - cum - Special Judge, Kaimur at Bhabua, in connection with Durgawati P.S. Case No. 201 of 2019.

The cash deposit of Rs. 50,000/- shall abide by the final outcome of the pending criminal case.
