JUSTICE VINOD KUMAR SINHA ORAL ORDER 31-01-2020 Petitioners seek bail in connection with Bodh Gaya P.S. Case No. 67 of 2013, registered for the offences punishable under Sections 147, 148, 149, 323, 324, 341, 342, 109, 114, 307 and 302 of the Indian Penal Code.

As per FIR six persons are named in the FIR, including the petitioners and 100 unknown persons and allegation is that they surrounded the deceased and killed him. Submission of learned counsel for the petitioners is that they are named in the FIR but nothing specific has been alleged against them and they are in custody for six months, charge sheet has been submitted and considering the same other co-accused persons have been granted bail by order dated

Patna High Court CR. MISC. No.59919 of 2019(4) dt.31-01-2020 2/2 14.8.2018 passed in Cr.Misc.No. 34138 of 2018. Heard learned APP also.

In view of above facts and circumstances, let petitioners be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gaya, in connection with Bodh Gaya P.S. Case No. 67 of 2013.
